They will not, however, agree to another.
A work stoppage has not been initiated by either party. Instead, a period of status quo that resembles typical working circumstances will be imposed on the league. Players can use team facilities as needed, and they can still communicate with management.
The union said in a statement that "the WNBA and its teams have failed to meet us at the table with the same spirit and seriousness, despite demonstrating our willingness to compromise in order to get a deal done." "Instead, they have continued to run out of time, minimise player contributions, and ignore player concerns."
In a statement issued late Friday night the league acknowledged the CBA's expiration but stated that talks with the union are still ongoing.
The league said "We understand the significance of building upon that momentum as the league experiences a pivotal time of unprecedented popularity and growth." "A deal that substantially raises player salaries improves the overall player experience and supports the league's long-term growth for present and future generations of players and fans is our top priority."
The players' union protested by bringing a big inflatable rat to the NBA Store in New York City on the last day of the deal. However union vice president Breanna Stewart who is taking part in Unrivalled in Medley, Florida stated that she thinks the two parties would keep up their good-faith negotiations.
The new CBA's pay structure continues to be the main source of disagreement. Although the league's plan eliminates top-level expenses before distributing a revenue share to players, players have suggested a structure that would give them thirty percent of gross revenue. With average earnings exceeding $530,000 in the first year of the league's proposal and surpassing $800,000 in the union's most recent offer, the two systems would significantly increase player compensation. The current CBA has a maximum wage of roughly $250,000.
The duration of the schedule, retirement benefits, and the core designation in free agency are also further issues of contention.
Since its founding in 1997, the WNBA has never missed a game because of a work stoppage. Although extensions were necessary for the last two discussions, the CBA did not expire, resulting in a period of status quo.
The league could theoretically start free agency during the status quo period because the calendar has changed to January; contract terms would be determined by the expired CBA. However, when a windfall in the form of a new CBA is imminent, it is improbable that players would agree to sign contracts under an antiquated financial model.
In order to prevent players or teams from signing contracts out of turn, the league and players might potentially agree to a moratorium that would prevent free agency until a new deal is reached. As of Friday night, the WNBA has offered a moratorium to the players under review by the union.
The WNBA must have an expansion draft for the Toronto Tempo and Portland Fire, free agency, a college draft, and training camp if and when a new contract is reached during the offseason.
